U.S. Supreme Court reviews ban on inter-sports in women’s sports

The U.S. Supreme Court has agreed to review whether state law can prohibit trans athletes from participating in women’s and women’s sports.

The case involved Idaho and West Virginia laws, and two trans students won a lower court injunction that allowed them to continue to compete.

The Supreme Court will examine the cases of Becky Pepper-Jackson, 15, and Lindsay Hecox, 24, who successfully challenged the state bans in West Virginia and Idaho by arguing that they were discriminatory.

Idaho is the first state to pass laws that prohibit trans athletes from participating in women’s and women’s sports. After that, the other twelve states followed.

Ms. Hecox is a long-distance runner who posed a legal challenge to Idaho law in 2020 shortly after its inception. Later, she was granted an injunction by the District Court and the Court of Appeal.

State Representative Barbara Ehardt, who introduced the law, said at the time of his death that it would ensure that “boys and men will not be able to replace girls and women in sports because it is unfair.”

But in the appeal ruling, a panel of three judges found that the Idaho law violated constitutional rights and that the state “failed” to provide evidence that the law protected “sexual equality and opportunity for female athletes.”

West Virginia Attorney General John McCuskey supported the Supreme Court’s intervention.

“The people of West Virginia know that it’s unfair to have male athletes compete with women; that’s why we’ve passed common laws that provide women with women’s sports,” he said.

The Joshua neighborhood of the American Civil Liberties Union (ACLU), which represents athletes, insists that the lower courts are correct and can prevent “discriminatory laws.”

“Excluding children from school sports just because trans people are trans people will only make our schools safer and more hurtful places for all young people,” he said.

How the Supreme Court decides to rule on the issue may affect other states with similar injunctions.

At the federal level, President Donald Trump signed an executive order earlier this year Trans women and girls are prohibited from participating in women’s sports teams.

The Supreme Court will hear the challenge in its next term starting in October. No hearing date has been set.
