“This ruling delays justice and tries to surrender to the president’s constitutional vested powers,” she said. “We hope the High Court will defend us.”
Federal courts prevented Trump from ending most TPS enrollment rates in his first term.
A chapter of nine Haitian TPS holders, church associations and international service employees filed a lawsuit on March 14, saying Noem did not conduct the necessary review of Haiti’s current situation before ending TPS as early as possible.
More than one million people, more than half of the children are internally displaced in Haiti, despite the UN-supported security missions that have been launched last year, where gang violence is prevalent.

Noem shared Trump’s tough stance on immigration and turned to TPS with about 350,000 Venezuelans and thousands from Afghanistan and Cameroon.

Norm has the right to grant TPS to people from countries that encounter natural disasters, armed conflicts or other extraordinary events for six to eight months.
The Haitian plaintiffs also claimed that the suspension of their TPS status was partly motivated by racial discrimination, which violated their constitutional rights to equally protect.
Trump falsely stated in a September 2024 debate with Democratic candidate Kamala Harris that Haitian immigrants in Springfield, Ohio were eating pets, sparking fear of revenge for Haitians.
