Former special counsel Jack Smith responded to a government regulator’s investigation into his two presidential indictments through a lawyer Tuesday Donald Trumpcalling the inquiry is unfounded.
Smith wrote in a letter to the Office of Special Counsel (OSC) in Covington and Covington & Burling’s attorney, Smith wrote in a letter to the Office of Special Counsel (OSC) that its investigation’s predicate is “fictional and unfounded” and that Smith follows all the rules and principles of the Justice Department in his work.
His attorney wrote: “Smith’s actions as special counsel are consistent with the decision of the prosecutor, who is committed to following facts and laws without fear or favor without regard for political consequences rather than for them.”

The Office of Special Counsel is an independent agency that has nothing to do with the Department of Justice or special attorneys such as Smith.
OSC, which acts as a regulator, handles complaints from government whistleblowers and investigates Incubation method Federal employee violations. It can impose administrative penalties for misconduct, including fines or termination of government work. Fox News confirmed this month that the OSC is investigating Smith under the Hatch Act, which prohibits certain government employees from working in political campaigns at work.
The OSC investigation is in R-ARK. Senator Tom Cotton asked Smith to seek expedited Trump’s prosecution in a letter to the OSC.
“In addition to attempts to influence the outcome of the 2024 election, many of Smith’s legal actions seem to be unreasonable, which would violate federal law,” Cotton wrote.

Smith spent about two years investigating and prosecuting Trump during the Biden administration. He filed two indictments against Trump, one of which accused him of violating the Espionage Act because of unfortunate defense information and another alleged that he tried to subvert the 2020 election. Smith dismissed both cases after Trump won the 2024 election, a move that is consistent with long-standing policies on prosecution of the incumbent president.
Smith’s attorney wrote that cotton cited the cotton action in his letter, including demanding the court to relocation lawsuit and allowing him to file a longer summary, which was “not obvious” and was the prosecutor’s standard and approved by the court.
“This investigation is based on partisan complaints, which suggests that ordinary actions in the criminal justice system should be whimsical about the political race,” Smith’s lawyer wrote.

This letter is for the U.S. Trade Representative Jamieson Greerhe serves as acting head of the special lawyer’s office, while Trump’s nominee faces obstacles confirmed by the Senate.
The attorney asked Greer to contact them directly before taking any further steps to investigate Smith so that his findings, if any, could “full knowledge of the records.”
