President Trump said in recent days his administration aims to expand DC’s operations to other states and told a group of federal agents and National Guard units at the DC Patrol Center Thursday: “We will make sure it is safe and then we will continue to travel elsewhere.”
At the Oval Office on Friday, Trump said: “I think Chicago will be our next one. Then we’ll help you New York,” Trump said.
“We won’t speculate on further action, but we can tell you that the department is a planning organization and continues to work with other agency partners and plans to protect federal assets and personnel,” a U.S. defense official told Fox.

The Virginia National Guard confirmed that less than 2% of the mandated forces have been mobilized so far, but the mission coordinated under the governor is expected to be expanded in the coming weeks, including in Virginia where approximately 60 soldiers and pilots will begin training on August 25, starting in early September, and thus tariffs will begin in early September.
“VNG personnel will not perform law enforcement functions, and VNG’s support will not include arrests,” a spokesperson for the Virginia National Guard told Fox. “VNG soldiers and pilots will report directly to the ICE leadership at their designated locations of responsibility, but are still under the control and guidance of the Virginia governor and Virginia adjutant.”

Under the POSSE COMITATUS Act of 1878, the use of the military for civilian law enforcement is limited – but the National Guard will mobilize institutions authorized under Article 32, 32, 502F, and Posse Comitatus does not apply. At the request of the Department of Homeland Security, in July, Secretary of Defense Pete Hegseth approved hundreds of DHS-ICE internal law enforcement support forces and converted existing approvals from Title 10 to Title 32 identity.
“We understood the needs of ICE at the time to be more administrative in nature… As the program continues, working with our partners, it becomes increasingly clear that ICE needs something different.”

“You can imagine and appreciate that some of them are starting to approach that line of enforcement. So, the best thing is that these people are in Title 32 identity so that we absolutely comply with the laws we do and provide proper support,” the official said.
Most deployments are still in the planning and coordination phase with the Department of Homeland Security and the governor, but documents show operations from Idaho, Indiana, Iowa, Iowa and Nevada in the first week of September.
“Under the 32nd champion, the guards are under the command and control of the governor. So it depends on the governor bringing these forces… As a force coordinated by the governor and the states with the Department of Homeland Security, the timeline will vary by state.” Vermont refused to activate its National Guard despite the Pentagon’s authorization to assist DHS-ICE’s internal law enforcement mission.

Under the direct presidential authorities, guard members are assigned to monuments, checkpoints and traffic stops in all eight wards, with a mission focused on preventing crime and maintaining a visible and secure presence around the city.
Under the authorization of Secretary Heggs, these National Guard members can now carry weapons if needed. But DC is different under Title 32. For the states, it depends on the individual governors who serve as command and control.
Although the mobilization and activation of the DC National Guard in 19 states are part of President Trump’s larger directive to protect territorial integrity and immigration policies, these tasks are obvious and independent.
