The U.S. Court of Appeals for the Second Circuit unanimous on Wednesday / Innocence Douglass Mackey’s federal conspiracy charges and returns the case to a U.S. court in the Eastern District of New York to make a new acquittal.

The verdict was a victory for Mackey, a self-proclaimed right-wing influencer and self-proclaimed “Troll” who amassed about 58,000 followers on Twitter during the 2016 election advance.
Mackey, who used the handle “Ricky Vaughn”, used his account to post false information designed to support the then presidential candidate Donald Trumpincluding memes designed to look like Hillary Clinton ads, telling voters that they can submit their votes via text messages.

The three panel of judges ruled Wednesday that McGee’s position, including the false memes he posted, did not have enough evidence to prove that he violated the U.S. conspiracy law, “even assumed that he did so to make the voting rights of other citizens harm other citizens,” they said.

“The government has an obligation to show that McGee has intentionally reached an agreement with others to achieve this,” wrote Chief Justice Debra Ann Livingston and Judges Reena Raggi and Beth Robinson. “This is something the government has not done.”
The decision was praised by Mackey, who immediately posted information about the verdict on social media.

“Hallelujah!” McGee said on X after the appeals court ruling on Wednesday. McGee continued to thank God, his family, his wife, lawyers and others who supported him in the subsequent trial. He then threatened to take legal action against his conviction.
“Now we sue,” he said.
