Federal judge filed lawsuit against Maryland judge

A federal judge filed an unusual lawsuit filed by the Trump administration against all 15 judges in the Maryland District Court on Tuesday, a court-based lawsuit against Deportation Case.

Judge Thomas Cullon, appointed by President Donald Trump, scolded the administration for confrontational lawsuits and said he was dismissed because the judges are protected by judicial immunity and the executive lacks a position to file a claim first.

Cullen criticized the government for not only prosecuting the chief judge of the district court, who issued relevant court policies, but also “opinally a good measure.”

The policy, known as a regular order, requires the clerk of the court Maryland Automatically enter administrative suspension in cases caused by suspected illegal immigrants suspected of challenging their detention or dismissal. The role of these bans is to temporarily prohibit the Department of Homeland Security from deporting or changing the legal status of immigrants until the judge has time to review the case.

Chief Justice George Russell, who issued the regular order, pointed out that before a judge can review it, policy changes must be temporarily maintained in deportation cases to help the courts maintain the status quo in deportation cases. Russell cited a large number of immigration lawsuits filed in court, including on weekends and festivals.

Government lawyers argued on behalf of the Bureau of Homeland Security that the order violated the department’s authority over immigration policies and that “frustration and desire for greater convenience did not grant the defendant permission to violate the law.” They said the courts have no authority to automatically interfere in all deportation lawsuits and briefly put them on hold.

Cullen, based in the western Virginia area, presided over the lawsuit because the Maryland judge withdrew himself.

Cullen’s 39-page order imposes harsh words on the Trump administration. The judge said he was not surprised that “the administration chose a different, totally confrontational path” rather than challenging policy on a case-by-case basis, which the judge said was the appropriate path.

“Although some tension between the coordinate branches of government is a hallmark of our constitutional system, the unanimous efforts of executive officers to smear and deprive individual judges who rule against this ruling are both unprecedented and unfortunate,” Coulun said.

The Trump administration quickly appealed to the ruling of Cullen to the U.S. Court of Appeals for the Fourth Circuit.
