Getty ImagesTwo Elon Musk-backed businesses have formally sued Apple and Openai, accusing them of illegally joining the military to block threats from potential competitors.
The lawsuit, filed in the U.S. by X and XAI, aims to integrate OpenAI’s chatbot into the operating system of its smartphones, an exclusive arrangement that it says violates competition law.
Earlier this month, he claimed that Apple favored Openai in its App Store rankings, making Musk’s threat to the two tech giants good.
Apple did not immediately respond to a request for comment, while Openai said the document “consistent with Mr. Musk’s ongoing harassment pattern.”
Musk and Openai’s Sam Altman co-founded Openai in 2015.
But the two have since become painful rivals, with Mr. Musk accusing Artman of leading Openai in the name of public interest for too far.
Their battle intensified as Musk set up his own AI company, including chatbot alternatives (Xai and Grok).
In a lawsuit filed in a Texas federal court, Musk’s company claimed that “there is no valid Apple-Openi deal is a proprietary business reason” – believes that the 2024 arrangement makes competition more difficult and gives Openai access to tips and activities from millions of Apple customers.
It said the deal also provides the Chatgpt app with the advantage of the app store: “to increase downloads compared to other AI-generating chatbots.”
“The Apple-Openai arrangement has eliminated competition between generative AI chatbots, stripped competitive generative AI chatbots, and reduced quality and innovation,” the two companies said in the lawsuit. “All of these impacts, in turn, helped Openai and Apple maintain a monopoly.”
According to the lawsuit, Openai controls about 80% of the U.S. market for generative AI chatbots, while Apple claims about 65% of the smartphone market.
Its collaboration with other tech giants and App Store practices has been the subject of many legal battles, including a high-profile antitrust lawsuit against Google.
Apple has previously defended its App Store practices, saying they are “fair and without bias.” Since 2024, several Chatgpt competitors such as DeepSeek and Confusion have surpassed the App Store rankings.
The company also reportedly had a conversation with Google, which used the company’s Gemini Chatbot to help its voice assistant Siri.
