Details are unclear which former officials face potential charges, the litigation is about to occur and which specific allegations of misconduct can support criminal prosecution. The Justice Department did not respond to a request for comment.
The development that the Justice Department has been used to achieve political purposes may attract attention due to a long investigation into Trump’s investigation into Russia, which calls for imprisonment of perceived political opponents, as any criminal investigation revisits one of the most declared chapters in modern American political history. It also surfaced as the Trump administration was criticized for handling documents in it Jeffrey Epstein Sex trafficking investigation.
An investigation into the initial history of Russian election intervention led to the appointment of a special lawyer, Robert Mueller, who convicted Trump aides and allies but did not determine evidence of crimes between Moscow and the Republican campaign.
Mueller’s investigation documented extensive Russian intervention in the 2016 election and identified multiple incidents that Trump could hinder justice, with the special counsel clearly pointing out that his report did not exempt the president.
The investigation covered Trump’s first presidency, and he has long focused his anger on top senior officials in the intelligence and law enforcement circles, including former FBI director James Comey, who was fired in May 2017 and former CIA director John Brennan. The Justice Department appeared to have confirmed the investigation into the two men in an unusual statement in July, but provided no details.
Several special lawyers, Congressional committees and the Justice Department’s own inspector general have studied and documented Russia’s multi-mand efforts in the 2016 presidential election representing Trump, including targeting shaky accidents and swing public opinion through the Democratic Party’s secret sales and secret social media actions to cover up social media.
The Republican-led Senate Intelligence Committee released a comprehensive bipartisan report in 2020 confirming extensive Russian intervention and documenting the links between Trump’s campaign mates and Russians. It found that campaign chairman Paul Manafort shared internal poll data with Russian intelligence officials, the campaign welcomed Russian aid.
But the conclusion has been actively challenged in recent weeks as Trump’s director of national intelligence Tulsi Gabbard and other allies released previous confidential records that they hope to raise doubts about the extent of Russian intervention and establish the Obama administration’s efforts to connect Trump to Russia in false efforts.
In a batch of documents released in July, Gabbard revealed emails showing Barack Obama administration officials realized in 2016 that Russians did not hack into the state election system to manipulate Trump’s votes. But Obama’s administration never claimed that the vote was tampered with, but rather detailed other forms of election interference and foreign influence.
Last week, Republican Senate Judiciary Committee Chairman Chuck Grassley posted a series of emails last week, with FBI Director Kash Patel claiming on social media that Hillary Clinton’s 2016 White House campaign “drawing President Trump and creating a scam of Russian collusion, and this new outcry surfaced.”
The emails are part of a report released by John Durham in 2023.
Durham did find significant flaws in the investigation, but found no blockbusters to refute the existence of Russian election intervention. His investigation brought three criminal cases – two that resulted in acquittal of the jury and the third was a guilty plea from a lesser-known FBI attorney, alleging to make false statements.
During the Trump administration, multiple investigations, including his own Justice Department inspector general, concluded that the initial decision to open the investigation was correct despite the FBI’s procedural errors in the Russian investigation.
Republicans caught an email in a newly declassified attachment on July 27, 2016, claiming that Clinton approved a plan during the campaign to connect Trump to Russia.
But the letter was allegedly authored by a senior official at a charity founded by billionaire investor George Soros, told Durham’s team that he had never sent an email, and the alleged recipient said she never recalled receiving the email.
Durham’s own report noted that investigators were unable to verify the communication as a real communication, assessing that the message could be “a combination of several emails obtained through Russian hacking”, suggesting that it could be a false information from Russia.
