Minnesota Senator Nicole Mitchell was convicted of felony burglary Friday and has been invaded into her stepmother’s home for more than a year.
Mitchell has faced pressure to resign from both sides of the aisle since his arrest, but some defenders say she should get her day in court. One is Minnesota Senate Majority Leader Erin Murphy, who, like Mitchell, is a member of the Democratic Peasant Party (DFL).
“Senator Mitchell was given a proper procedure and was tried by a peer jury, which had been decided. I’m glad to see the trial of Senator Mitchell ended. The resolution of the case made the situation clear,” Murphy said in a statement after the DFL verdict.
“Senator Mitchell told colleagues that she intends to resign if she is guilty of this crime and I hope she can keep that commitment. Our caucus remains focused on issues that are important to Minnesota’s families and communities.”

The state legislator was arrested in April 2024 for suspected invasion of his stepmother’s home. Mitchell said she went to the home of her stepmother Carol Mitchell to retrieve her late father’s belongings. The state senator claims her stepmother has Alzheimer’s disease.
Mitchell testified that she broke into her stepmother’s home and admitted why she lies there, but it was done out of concern for her stepmother According to Axios.

Mitchell’s video Inside the police cruiser Handcuffs were shown and questioned during her trial. In the video, she told an officer she “just wanted something from my dad” and “apparently, I’m not good at that.” Mitchell told police that her stepmother “is not going to talk to me anymore,” which is why she resorted to breaking into the Detroit Lakes.
Mitchell said she wanted to retrieve her father’s ashes, pictures, clothes and other sentimental items.

Although no verdict date has been set, Mitchell will be sentenced to at least six months in prison and hold up to 20 years in prison, according to Axios.
