The agency said Friday that the Department of Education is providing five Northern Virginia school districts with ten days to determine their transgender bathroom policies or face “law enforcement actions.”

The agreement also requires that these districts send letters to each school they supervise in their area and explain that any future policies related to bathrooms, locker rooms or other private spaces must separate students based on gender rather than gender identity.
Under the agreement, these regions will also be forced to adopt “Biology-based definition” The terms “male” and “female” used in all practices and policies.
The Ministry of Education has provided the district with 10 days of voluntary agreement to these requests or “imminent” consequences, including potential referrals to the Justice Department.

The districts have confirmed that they have received a resolution agreement sent to them by the Ministry of Education and are under review to determine the next step.
