Experts say Trump’s National Guard deployment could be spared a court challenge

President Donald Trump’s controversial deployment National Guard For Los Angeles and other cities, legal experts may survive judicial review despite federal judges ruling a violation of the Posse Comitatus Act.

Experts say that even under the Posse Comitatus Act, the court received almost all respect for the president in terms of military use. The 150-year-old law says the military can’t usually work in standard police.

Andrew Stoltman, an adjunct law professor at Northwestern University, told Fox News Numbers that he believes the Supreme Court will eventually approve the president’s unconventional use of the National Guard. The court often supports Trump in this year’s interim ruling.

“I think he will get the legal green light in the end. But he obviously did this in a heavy blue country, so he eventually had to bring it to the Supreme Court,” Stolman added, “but I think that as the president’s power expands, it will eventually be stamped in the legal seal approved.”

Federal Judge Rules Trump violates military law by activating California’s National Guard

In California, Judge Charles Breyer found in a lawsuit filed by Democratic Gov. Gavin Newsom that Trump had conducted an inappropriate federal federal response to anti-immigration and customs enforcement protests and riots.

Posse Comitatus Act Act

Breyer, a Clinton-appointed man and brother of retired Stephen Breyer, was later discovered that Trump and Defense Secretary Pete Hegseth violated the POSSE COMITATUS Act by commanding forces, including thousands of National Guard soldiers and hundreds of Marines, to perform basic law enforcement tasks such as stopping traffic and conducting Riot Control.

Breyer said the Trump administration’s explanation is that the military is protecting federal personnel and buildings is an explanation of National Guard activities, which includes accompanying the Icebian and Drug Enforcement Bureau at three marijuana farms outside Los Angeles and participating in Operation Ekrabel, “a homeland security mission at Macartel Park.”

The U.S. Court of Appeals for the Ninth Circuit temporarily suspended Breyer’s two orders, but the lawsuit is still going through the court and may soon be the only lawsuit for the matter.

Gerard Filitti, an attorney for the Lawyer Program, identified the trap of Breyer’s order.

The judge “controlling the ordinary crowd is like illegal ‘enforcement’,” Felit said in a statement to Fox News digital numbers. “That’s not the law. Guards are not arresting people or conducting police investigations – they are stabilizing the situation so ICE can get the job done.”

“This distinction is important and the judge ignored it,” Filitti added.

In the California lawsuit, there are two laws that allow the president to have the federal National Guard, a mixed military force that would otherwise fall under the governor’s terms of reference. Trump cited the rebellion regulations, but he could have deployed his troops using another law known as the Uprising Act. This is a key consideration for Breyer.

“If the president wants to avoid it [Posse Comitatus Act’s] To limit, he must invoke valid exceptions – such as the Uprising Act, which is necessary to show that state and local law enforcement cannot or is unwilling to take action. ” Breyer wrote in the order last week.

“Dangerous Precedent”

Over the past week, the president has threatened to send troops to Chicago, as well as New York City, Baltimore and other cities, saying violent crime is rampant and raised emergencies that require a military response.

Filitti said that if Breyer upheld dangerous precedents in the High Court, it would “set dangerous precedents.”

“If there is a status left, it means that any state can stop federal law enforcement by refusing to help and boldly tying the president’s hands,” Feliti said. “It’s not how the constitution works, nor is it the way you keep Americans safe. The decision should and will be overturned and quickly overturned.”

Trump uses the National Guard in California as part of an effort to suppress immigration from major border countries, but the president has also said in the past week to use it to solve street crime, just like he did in Washington, D.C.

Trump deploys the National Guard and sends other federal authorities to Washington, DCaddressing crimes there, with a focus on immigration enforcement and homelessness.

Since then, the country’s capital has greatly reduced crimes, including carjacking incidents down Compared to this time last year, more than 40% of cases, in violent crimes, down 27% started last year. Democratic mayor Muriel Bowser attributed the Trump administration to crime reduction and signed a formal order last week to work with certain federal agencies.

But Bowser’s attorney general was less popular and was indicted, saying the National Guard response, including members of the National Guard outside the state, was unfounded.

DC is unique in that the president can use the DC National Guard as part of the National Rule Act to take over enforcement operations there for 30 days, meaning that the DC Attorney General’s lawsuit is different from lawsuits or potential lawsuits filed in other jurisdictions. The 30-day expiration is Wednesday.

“Structural Issues” that Cause Crime

Chicago-based Stoltman said leaders of democracies and cities, such as Illinois outspoken Gov. JB Pritzker, would be a smart choice rather than follow Bowser’s leadership rather than boycott federal aid.

“Our governor and mayor are very opposed to Trump’s dispatch of troops, and I think politically, they made a big mistake.”

Despite some of the highest crime rates occurring in cities in the Red State, at this stage the president targets only the Blue State. Critics have pointed this out and say Trump is avoiding addressing potential factors driving crime, such as understaffing and local prosecutor policies such as cashless bail.

Zack Smith, a senior legal researcher at the Conservative Legacy Foundation, told Fox News Digital that he sees the National Guard as a direct response and does not necessarily address the root causes of the crime.

“What we are talking about in many cities is structural problems. In some cases of neglect and decay, we are talking about decades, so all of this won’t be resolved overnight,” Smith said.

He said he believes that in DC, the strategy has been successful in terms of huge numbers, “because we know that one of the most effective ways to combat violent crime is to have police officers capable of working properly on the streets and they have prosecutors willing to prosecute people when they break the law,” Smith said.

But, “In the long run, there is absolutely a need for a bigger conversation about the city’s will,” Smith added.
