this U.S. Department of Justice (DOJ) has initiated an investigation into the California Environmental Protection Agency (CALEPA) in allegations of racial equity-based recruitment practices.
The Justice Department notified the state environmental agency in a letter Wednesday, investigating whether it “engages in models or practices based on race, color, gender, gender and ethnic origins, violating Chapter VII of the Civil Rights Act of 1964.”
“Our investigation is based on information that Calepa may engage in employment practices to discriminate against employees, job seekers and training program participants to race, color, gender and ethnic origins, violating Chapter VII,” he said. The letter specifically cites Calepa’s “practice” document to promote racial equality in workforce planning, which promotes “applying racial equality lenses at every stage of workforce development” and states that “the interview team should reflect race, race, gender and other diversity as much as possible”.
“Including different people and perspectives in the hiring process, including people of color, can reduce the impact of within-group bias in recruitment,” the document reads.

The document also urges Hiring Manager Participate in “screening practice” to illustrate “cultural ability and life experience”.
“In forming screening criteria, focus will be on applicable knowledge, skills and abilities to include keys related to cultural competence and life experience in the screening criteria,” it wrote.
“Ethnic-based employment practices and policies in local and state institutions in the U.S. are in violation of equal treatment by law,” Dhillon said in a statement announcing the investigation.

She continued: “The illegal use of protected characteristics as a factor in the serious legal consequences of employment and employment risks.”
