City of Oregon, which attempts to ban homeless camps, agrees to secure 150 campsites | Oregon

Oregon’s disability rights sued the grant in January and reached a settlement Friday. Advocacy groups accuse the city of discrimination against people with disabilities and violate a state law requiring the city’s camping regulations to be “objective and reasonable.”

Grants Pass has received national attention for challenging her sleep outside and prosecuting people who are not under investigation. The city’s legal battle led to a Supreme Court ruling that local governments across the United States could commit camping crimes even if there is no shelter available for homeless people.

“This reconciliation is an important step in ensuring that people with disabilities are homeless, essential essentials like drinking water and a real opportunity to stabilize their lives.” Oregonsaid in a statement.

Grants Pass Mayor Clint Scherf said in an email Tuesday that the city appreciated the agreement and would “continue to work towards effective measures to benefit all members of our community.”

A copy of the settlement shows that the city signed it earlier this month.

Josephine County Circuit Judge Sarah McGlaughlin issued a preliminary injunction in March when preventing the city from enforcing its camping rules, unless it increases the capacity of city-approved camping sites and ensures that people with disabilities are physically available.

In most cases, city regulations prohibit sleeping or leaving personal property in the park overnight. Those who find violations can be fined up to $50.

The city said on Facebook Friday that law enforcement “will start to notice the park and residents will have 72 hours to remove their items.”

The city’s website shows three “designated rest locations” near the downtown and city hall where people can stay for four days before having to relocate. The City said on Facebook that time limits can be enforced unless disability accommodation is required.

In the resting location, individuals are limited to 8 feet by 8 feet (2.4 meters by 2.4 meters), with a buffer between spaces of 3 feet (0.9 meters), as described in the city code.

Under the solution, the grant pass must ensure that at least 150 camping spaces comply with the Americans with Disabilities Act over the next 12 months. Drinking water and hand washing stations must be provided on site.

The city must also provide $60,000 in grants to nonprofits to provide homeless services.

Grants Pass, a small city along the Rogue River in southern Oregon, has about 40,000 cities that have struggled for years to resolve the homeless crisis and symbolize a national debate on how to deal with it. Its parks have become particularly a flashpoint, with many becoming the site of camps destroyed by drugs and garbage.

Last June, in the case brought by the city U.S. Supreme Court Ruled communities can prohibit sleeping outside, even if there are not enough shelter beds.

After the High Court ruling, a grant pass prohibits camping on all city property except the location designated by the City Council, which established locations for hundreds of homeless people in the town to keep them away from the park.

After taking office in January, the new mayor and new council members moved away the larger site of two sites of about 120 tents, which is often crowded with harsh conditions that are inaccessible by disabled people due to loose gravel. After the lawsuit was filed, New York City reopened its second small location.

McGloin’s order in March said New York City must improve its capabilities to large-scale site closures before it closes.

Elsewhere, the California city of San Jose also plans to open approved campgrounds, in addition to “safe parking” for people living in vehicles such as RVS. There is also an approved camping program in the city of San Rafael, which is also in the San Francisco Bay Area.

Last year, homeless people grew 18% nationwide, mainly due to a lack of affordable housing and devastating natural disasters and an increase in immigration in some areas.
